RELEASE: NO MORE HATE CRIMES NO MORE HATE CRIMES FOR SEXUAL ORIENTATION AND GENDER IDENTITY
Given the alarming increase in homicides in which the victims belong to the community transsexual, organizations and individuals undersigned We wish to publicly state that:
1 .- The recent murders of transgender people in Caracas can be established unambiguously as hate crimes related to sexual orientation and gender identity.
2 .-- violence based on sexual orientation and gender identity is a clear indication of the violation of human rights of transsexuals, transgender, intersex , gays, lesbians and bisexuals. We are talking about violations of the rights to life, personal integrity, public safety, as well as the free development of personality and sexual rights. The existence of hate crimes related to sexual orientation and gender identity also expresses the structural violation of the right of non-discrimination, transsexuals, transgender, intersex , gays, lesbians and bisexuals. In this situation affect both economic factors and cultural background heterosexist, patriarchal and macho characteristic of Latin American regional. The vulnerability of these people is heightened by the fact of the lack of recognition of legal identity consistent with his physical-psycho-social, which follows the removal of almost all the most basic fundamental rights: the right to education , health, safety, work, freedom of movement, to enjoy decent housing, which leads to the vast majority have no other option for survival in the area of \u200b\u200bsex work, particularly in the street; a fact which, in turn, increases the vulnerability in the area of \u200b\u200bpersonal safety and health.
Since the nineties, a holistic approach to human rights including sexual and reproductive rights in two key dimensions of personality development: sexuality and reproduction. Both dimensions of the individual should be viewed independently but are linked to their mental and social well-being and growth integral. Important international agreements devoted, confirmed and extended these rights. Within the international human rights law applied to issues of sexual orientation and gender identity, a major milestone is also the "Yogyakarta Principles", adopted at a meeting multidisciplinary experts from 25 countries, held in Gadjah Mada University, Yogyakarta, Indonesia, from 6 to 9 November 2006, and officially re-launched in Geneva at a meeting of the Human Rights Council of the UN, March 26, 2007. More recently, Venezuela was a signatory of the Declaration of UN Human Rights, Sexual Orientation and Gender Identity, signed by more than 66 countries on 18 December 2008, which urges States to take effective measures to prevent violence and discrimination against people because of their sexual orientation and gender identity, and to assure the full enjoyment of all rights, including the right to identity, health, housing, work and study.
Among sexual rights provide for any genuine and effective to develop a pleasurable sexuality, responsible, fully and safely under conditions of equality, consent and respect; the right to make autonomous decisions free of coercion over their own sexuality and the body, including sexual orientation and sexual identity, the right to enjoy equal social and regulatory framework that enables all people to develop life sexual equality without any discrimination, the right to enjoy a satisfactory sexual health and access to a wide range of health and social services, the right to receive sex education based on a positive approach to sexuality; the right to think and freely express ideas about sexuality, the right to protection against any threat, violence or practice harmful to the body or sexuality, the right to be free from torture or inhuman or degrading treatment. The full exercise of sexual rights involves implementing programs to promote gender equality, combating gender violence and recognition of sexual diversity.
3 .- The Constitution of the Bolivarian Republic of Venezuela, presupposes a society where equality and a secular state that works to eradicate the huge asymmetries of power, wealth and status assessment that violate equally poor people women, indigenous peoples, peasants, the / o Afro-Venezuelan / as as gay, lesbian, bisexual, transgender and intersex. In this regard, we ask for solidarity from other sectors of society who are now demanding their rights and urge the State to adopt the following measures:
• The appointment of a team of prosecutors / is special for the investigation of hate crimes based on sexual orientation and gender identity
• Creation in the Public Defender, a Special Ombudsman for the community LGBTTI
• Design and implementation together with LGBTTI organizations, a National Awareness Plan rights LGBTTI community aimed at officials / public I / I and society
• eradication anachronistic law and practice of ONIDEX preventing transsexual and transgender obtain their identity using your own image.
• Inclusion and approval of the articles proposed by Rep. Romelia Matute in the current discussion of the Law on Gender Equity and the Commission for Women, Family and Youth of the National Assembly for political rights of the population LGBTTI.
